Summary of the Privacy Policy

Part I: Data Netanya Ltd collects and controls

We only collect data that we actually need to offer our services. Some of that is data that you actively give us when you fill forms in our website/services or ask for customer support. We store your name and contact information, but we don’t store credit card numbers (except with your permission and in one of our secured payment gateways).

When you visit one of our websites or use our software, we automatically log some basic data like how you got to the site, where you navigated within it, what features or settings you use, and the actions you performed. We use this data to improve our websites and products and to drive new product development.

What we do with your Data

We use your data to provide the services you’ve requested. We also use it to communicate with you about the products you’re currently using, your customer support requests, new products you may like, chances for you to give us feedback, and policy updates. We analyze the data we collect to understand user needs and to improve our services and user experience.

We’re required to have a legal basis for collecting and processing your data. In most cases, we either have your consent or need the data to provide the service you’ve requested from us. When that’s not the case, we must demonstrate that we have another legal basis, such as our legitimate business interests.

You can decline certain kinds of data use either by not providing the data in the first place or by opting out later. We completely disable non-essential and intrusive third-party cookies from all our products.

We are bound by global best practices and requirements and The Data Protection Act (2019) of Kenya, which provide certain rights to data subjects (including access, rectification, erasure, restriction of processing, data portability, and the right to object and to complain). We keep your personal data for as long as it is required for the purposes stated in this Privacy Policy. When we no longer have a legitimate need to process your data, we will delete, anonymize, or isolate your data, whichever is appropriate.

Part II: Data that Netanya Ltd processes on your behalf

If you handle other people’s data while using our services, such as data about your employees, you are entrusting that data to us for processing. The data you entrust to us for processing is called service data.

You own your service data. We protect it, limit access to it, and only process it according to your instructions. You may access it, share it through third-party integrations, export, update, or delete it.

We hold the data in your account as long as you choose to use Netanya Ltd’s services.

To exercise those data rights, please contact the person or vendor that entrusted the data to us and we will work with them on your request.

This Privacy Policy statement is made by Netanya Ltd and may be collectively referred to as “Netanya”, “we”, “us” or “our”.

Netanya Ltd’s Privacy Commitment

We only ask for the necessary data, that which is necessary to provide our products or is essential for doing business. The data we collect, which is outlined in this privacy policy, belongs to customers – and they can control what we do with it. Further, we do not sell customer data to earn advertising revenue, meaning we do not have an interest in collecting unnecessary data because it will fuel advertising revenue.

The goal of this policy is to make explicit the data we collect, how we utilize it, and how we will not.

Scope of this Privacy Policy

This Privacy Policy applies to all Netanya Ltd websites that link to it, including and all the associated subdomains. It also applies to the products and services provided by us through these websites or through our in-house applications.

Part I: Data Netanya Ltd collects and controls

What data Netanya Ltd collects

We collect data about you only if we need the data for some legitimate purpose. Netanya Ltd will have data about you only if (a) you have provided the data yourself or (b) Netanya Ltd has automatically collected the data. Below we describe the various scenarios that fall under each of those two categories and the data collected in each one.

(a) Data that you provide us

  1. Service request form:
    When you submit a service request form to access one or more of our services, we ask for information like your name, contact number, and email address to complete the account signup process.
  2. Payment processing:
    When you buy something from us, we ask you to provide your name, contact information, and credit card information or other payment account information. When you submit your card information, we store the name and address of the cardholder, the expiry date and the last four digits of the credit card number. We do not store the actual credit card number. For quick processing of future payments, if you have given us your approval, we may store your credit card information or other payment information in an encrypted format in the secured servers of our Payment Gateway Service Providers.
  3. Testimonials:
    When you authorize us to post testimonials about our products and services on websites, we may include your name and other personal data in the testimonial. (b) Data that we collect automatically

  1. Data from browsers, devices and servers:
    When you visit our websites, we collect data that web browsers, mobile devices and servers make available, such as the internet protocol (IP) address, browser type, language preference, time zone, referring URL, date and time of access, operating system, mobile device manufacturer and mobile network information. We include these in our log files to understand more about visitors to our websites.
  2. Data from cookies and tracking technologies:
    We use temporary and permanent cookies to identify users of our services and to enhance user experience. We use cookies, beacons, tags, scripts, and other similar technologies to identify visitors, track website navigation, gather demographic data about visitors and users, understand email campaign effectiveness and for targeted visitor and user engagement by tracking your activities on our websites. We mostly use first-party cookies and do not use third-party cookies or other third-party tracking technologies on our websites for non-essential or intrusive tracking.
  3. Data from application logs and mobile analytics:
    We collect data about your use of our products through application logs and use it to understand how your use and needs can improve our products. This data includes clicks, scrolls, features accessed, access time and frequency, errors generated, performance data, storage utilized, user settings and configurations, and devices used to access and their locations.

In addition to the purposes mentioned above, we may use your data for the following purposes:

Legal bases for collecting and using data

Legal processing bases applicable to Netanya Ltd: Our legal basis for data collection and use depends on the personal data concerned and the context in which we collect it. Most of our data collection and processing activities are typically based on (i) contractual necessity, (ii) one or more legitimate interests of Netanya Ltd or a third party that are not overridden by your data protection interests, or (iii) your consent. Sometimes, we may be legally required to collect your data, or may need your personal data to protect your vital interests or those of another person.

Whom we share your data with

Netanya Ltd does not sell any personal data. We share your data only in the ways that are described in this Privacy Policy, and only with parties who adopt appropriate confidentiality and security measures.

Employees and independent contractors:
Employees and independent contractors of Netanya Ltd have access to the data covered in Part I on a need-to-know basis. We require all our employees and independent contractors to follow this Privacy Policy for personal data that we might share with them.

Third-party service providers:
We may need to share your personal information and aggregated or de-identified data with third-party service providers that we engage, such as marketing and advertising partners, web analytics providers, and payment processors. These service providers are authorized to use your personal data only as necessary to provide these services to us.

Withdrawal of consent:

Your rights with respect to data we hold about you as a controller

You have the following rights with respect to data that Netanya Ltd holds about you.

Right to access:
You have the right to access (and obtain a copy of, if required) the categories of personal data that we hold about you, including the data’s source, purpose and period of processing, and the persons to whom the data is shared.

Right to rectification:
You have the right to update the data we hold about you or to rectify any inaccuracies. Based on the purpose for which we use your data, you can instruct us to add supplemental data about you in our database.

Right to erasure:
You have the right to request that we delete your personal data in certain circumstances, such as when it is no longer necessary for the purpose for which it was originally collected.

Right to restriction of processing :
You may also have the right to request to restrict the use of your data in certain circumstances, such as when you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

Retention of data

When we no longer have a legitimate need to process your data, we will delete or anonymize it from our active databases. We will also securely store the data and isolate it from further processing on backups until deletion is possible.

Data entrusted to Netanya Ltd and purpose

Data provided in connection with services: You may entrust data that you or your organization (“you”) control, to us in connection with use of our services or for requesting technical support for our products. This includes data regarding your customers and your employees (if you are a controller) or data that you hold and use on behalf of another person for a specific purpose, such as a customer to whom you provide services (if you are a processor). The data may either be stored on our system when you use our services, or transferred or shared to us as part of a request for technical support or other services.

Ownership and control of your service data

Netanya Ltd recognizes that you own your service data. We provide you complete control of your service data by providing you the ability to (i) access your service data and (ii) export or delete of your service data or request us to do this for you.

How we use service data

We process your service data when you provide us instructions through the various modules of our services. For example, when using our task management app, data such as customer name and contact information is used to create a task/order.

Whom we share service data with

Netanya Ltd and third-party sub-processors:

In order to provide services and technical support for our products, we engage other group entities and third parties.

Employees and independent contractors:

We may provide access to your service data to our employees and individuals who are independent contractors involved in providing the services (collectively our “employees”) so that they can identify, analyze and resolve errors. We ensure that access by our employees to your service data is restricted to specific individuals, and is logged and audited. Our employees will also have access to data that you knowingly share with us for technical support or to import data into our products or services. We communicate our privacy and security guidelines to our employees and strictly enforce privacy safeguards internally.

Retention of data

We hold the data in your account as long as you choose to use our services. Once you terminate your organization’s account with Netanya Ltd, your data will eventually get deleted from active database during the next clean-up that occurs once every month. The data deleted from active database will be deleted from backups after 3 months.

Data subject requests

If you believe that we store, use or process your data on behalf of one of our customers, please contact the customer if you would like to access, rectify, erase, restrict or object to processing, or export your personal data. We will extend our support to our customer in responding to your request within a week after receipt of the request.

How secure is your data

Netanya Ltd takes data security very seriously. We have made numerous safeguards to prevent unauthorized access, use, modification, disclosure or destruction of the data you entrust to us. Disclosures in compliance with legal obligations

We may be required by law to preserve or disclose your personal data and service data to comply with any applicable law, regulation, legal process or governmental request, including to meet national security requirements.

Business Transfers

In the event that we sell our business or get acquired or merged, we will ensure that the acquiring entity is legally bound to honor our commitments to you. We will notify you via email or through a prominent notice on our website of any change in ownership or in the uses of your personal data and service data. We will also notify you about any choices you may have regarding your personal data and service data.
